However the foregoing, disputes, claims, or controversies regarding (i) patents, copyrights, ethical rights, trademarks, Confidential Information, or commerce secrets; (ii) claims of piracy or unauthorized use of the Tapjoy Advertiser Services; or (iii) your failure to pay fees or the recovery of money owed by you to Tapjoy (collectively, Excluded Claims”) shall not be subject to required arbitration.
Advertiser will not, will not comply with, and will not permit, authorize, or encourage any third social gathering to: (a) use the Advertising Service to transmit or otherwise distribute any Advertisement or content that’s illegal, defamatory, libelous, harassing, abusive, fraudulent or obscene, that incorporates viruses, or is in any other case objectionable, as fairly decided by Tapjoy; (b) intervene or try and intervene with the correct working of the Advertising Service or forestall others from accessing or using the Promoting Service; or otherwise (c) use the Promoting Service in a fashion not expressly licensed hereunder or for any fraudulent or unlawful function.
